Welcome to MeMorial, a digital memory platform operated by Memorial. These Terms and Conditions ("Terms") govern your access to and use of the MeMorial platform, including any content, functionality, and services offered through our website, mobile application, or other associated channels (collectively, the "Service").

By registering for, accessing, or using MeMorial, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use the Service.


1. Eligibility and Acceptance of Terms

To use MeMorial, you must be at least 13 years of age or the minimum legal age in your country to consent to data processing. If you are under the legal age, you must have permission from a parent or guardian.

By using MeMorial, you represent and warrant that:

  • You are legally competent to enter into a binding agreement.

  • Your use of the Service complies with applicable laws and regulations.

  • You will comply with these Terms at all times.

2. Account Registration and Security


2.1 Creating an Account

To access certain features of MeMorial, such as creating or managing memorial pages, you must register and maintain an active user account. You agree to provide accurate, complete, and current information during registration and to update your information as necessary to keep it accurate and complete.


2.2 Security Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access or breach of your account.

You agree that:

  • You will not share your login credentials with anyone else.

  • You are solely responsible for all activities that occur under your account.

  • We may suspend or terminate your account if we suspect unauthorized use or breaches.

3. Permitted Use of the Service

MeMorial is a platform designed for commemorating deceased individuals with respect and dignity. By using the Service, you agree to:


  • Create memorial pages only for deceased individuals and with proper respect and factual representation.

  • Share personal memories, images, videos, and text in good faith, with sensitivity to other users and relatives.

  • Use the platform only for lawful, non-commercial, and non-political purposes related to memorialization.

4. Prohibited Conduct

You may not use the Service to:


  • Create memorial pages for living individuals or without permission from the deceased’s next of kin or family members.

  • Impersonate any person or misrepresent your relationship to the deceased.

  • Upload or share content that:

    • Is illegal, abusive, obscene, defamatory, hateful, threatening, or harassing.

    • Promotes hate ideologies, terrorism, or violent extremism.

    • Is false, misleading, or disrespectful to the memory of the deceased or their families.

    • Violates any intellectual property rights or privacy rights.

    • Contains viruses, malware, or any other code designed to interfere with the functionality of the Service.

  • Manipulate or abuse the platform’s features (e.g., artificially inflating visit counts or rewards).

  • Use the Service for commercial advertising, solicitation, or political campaigning.

  • Publish false death notices or misleading information with the intent to harm, deceive, or confuse.

Violation of any of the above may result in content removal, account suspension, or legal action.


5. Content Ownership and License


5.1 User-Generated Content

You retain ownership of any content you upload to MeMorial, including but not limited to images, text, videos, and comments ("User Content").


By uploading User Content, you grant MeMorial a non-exclusive, royalty-free, worldwide, transferable license to use, display, host, distribute, and reproduce such content within the platform solely for the purpose of operating and improving the Service.


5.2 Responsibility and Rights

You affirm that:

  • You own or have the legal rights to share any content you upload.

  • Your content does not infringe on the rights of third parties (including privacy and copyright).

  • You grant MeMorial the right to moderate or remove content that violates these Terms or applicable laws.

We reserve the right to remove or restrict access to any content that violates our policies or applicable law without notice.


6. In-app purchases

  • Users can buy digital items for memorials.

  • All purchases are final, unless otherwise stated under applicable consumer protection laws. Refunds are only provided if required by law or explicitly stated in the purchase terms.

7. Platform Moderation and User Reporting

MeMorial maintains a respectful environment and encourages users to report inappropriate content through:

We reserve the right to:

  • Remove any content without prior notice if it violates these Terms or our community standards.

  • Temporarily or permanently suspend accounts involved in serious or repeated violations.

8. Termination and Account Deletion


8.1 By You

You may terminate your account at any time by contacting support or using the account settings.


8.2 By Us

We reserve the right to suspend or terminate your account or access to the Service if:

  • You violate these Terms.

  • We are required by law to do so.

  • Your activity poses a risk to the platform or its users.

Upon termination, your right to use the Service will immediately cease, and we may delete any associated content, unless otherwise required by law.


9. Disclaimers and Limitation of Liability


9.1 “As Is” Basis

The Service is provided on an “as is” and “as available” basis. While we strive to maintain reliable and respectful services, we do not guarantee:

  • Continuous or error-free access to the platform.

  • That all user-generated content will be accurate or appropriate.

  • That the service will be secure, free of viruses, or uninterrupted.

9.2 Limitation of Liability

To the fullest extent permitted by law:

  • MeMorial shall not be liable for indirect, incidental, or consequential damages.

  • We are not responsible for damages arising from the use, inability to use, or reliance on any content within the platform.

Some jurisdictions do not allow exclusion of certain warranties or limitations on liability, so these exclusions may not apply to you.


10. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify users via the app or the email associated with your account.

Your continued use of the Service after such updates constitutes your acceptance of the revised Terms.


11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Sweden. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Stockholm, Sweden.
